USCIS rescinds statelessness policy guidance

    United States Citizenship and Immigration Services (USCIS) issued a policy alert stating that it rescinded policy guidance in its Policy Manual on stateless people in the United States. Previous guidance from August 2023 had established an internal process for examining statelessness and its relevance to immigration applications, petitions, or requests.

    In the alert, USCIS states that the 2023 guidance is inconsistent with Executive Order 14161, “Protecting the United States from Foreign Terrorists and Other National Security and Public Safety Threats.” USCIS states that the rescission does not change whether a finding of statelessness can or should be used as a discretionary factor in an adjudication.
