August 4, 2025Pursuant to EO 14201 § 4(c), USCIS issued policy guidance in its Policy Manual to limit eligibility for transgender women seeking O-1A, E11 (both extraordinary ability), or E21 (exceptional ability) visas. The policy update treats participation of transgender women in women’s sports as a negative factor when determining whether they are at the top of their athletic field. USCIS also bars transgender women athletes seeking to compete in women’s sports from obtaining a National Interest Waiver of the job-offer requirement.
The update is effective immediately and applies to benefit requests pending or filed on or after August 4, 2025.
