USCIS updates policy on false claims to U.S. citizenship, unlawful voter registration, and unlawful voting

    USCIS updates its policy manual guidance on false claims to U.S. citizenship, unlawful voter registration, and unlawful voting in the naturalization context, consistent with EO 14148 and EO 14248. The policy clarifies that a false claim occurs when a noncitizen affirmatively indicates they are a U.S. citizen. It further provides that noncitizens who falsely claim to be a U.S. citizen or who have voted unlawfully will be issued a Notice to Appear under INA 237(a)(3)(D)(i) or INA 237(a)(6)(A), subject to limited statutory exceptions. USCIS will also generally deny naturalization applications once removal proceedings are initiated, except in cases based on military service.
