CBP withdraws from delegation allowing it to solicit, accept, and utilize gifts to care for noncitizens in federal custody

    September 23, 2026

According to an X post by Fox News correspondent Bill Melugin, CBP Commissioner Rodney Scott withdrew the agency from a Biden-era delegation (DHS Delegation 07107) permitting CBP and ICE to solicit, accept, and utilize gifts offered to DHS for the care of noncitizens in federal custody. The original directive was signed by Deputy DHS Secretary John K. Lien on May 3, 2022. CBP said it recently discovered the directive and moved to rescind it. In a memo announcing the termination, CBP Commissioner Rodney Scott wrote that the order is "no longer needed or appropriate," citing the significant decrease in encounters and apprehensions, the elimination of the need for private donations, and the policy's misalignment with the Trump administration's enforcement posture at the border.
