The article includes that 2022 guidance, instructing CBP agents not to apprehend or arrest migrants in waterways, on the border fence, and amid barriers; not to force or guide individuals back into waterways or other unsafe environments; and prohibiting forcible removals of migrants at the border. The new memo states that the 2022 guidance "imposed significant restrictions on interdiction tactics, . . . which diminished the ability of agents to respond proactively to illegal crossings."
