September 10, 2026The Census Bureau published a Notice of Proposed Rulemaking to exclude most noncitizens from the Census congressional apportionment counts. Under the plan, only U.S. citizens and lawful permanent residents would be counted toward a state’s share of House seats, leaving out undocumented immigrants and individuals on temporary visas. The Bureau asserts that "illegal aliens" lack sufficient ties and allegiance to satisfy the definition of "usual residence" in the United States. Under the proposal, questions about race, ethnicity, and sexual orientation would also be removed from the decennial census questionnaire to make the census "color-blind," protect privacy, and ensure that data is not "distorted in any way by questions about immaterial personal characteristics, such as race." The Census Bureau proposes greater reliance on administrative records for demographic and immigration-status information. The proposal is not yet final and is open for public comment through October 13, 2026.
