September 1, 2026The Department of Homeland Security (DHS) confirmed that they may conduct immigration enforcement operations at polling places across the United States. DHS Secretary Markwayne Mullin announced the policy when speaking to reporters, stating: "The only reason why we would be at polling places is if there is a threat to that polling place or we’re serving a warrant on someone that we have been actively tracking down . . . . [I]f we’re serving a warrant we will be where we need to be." A subsequent DHS statement added that "ICE is not planning operations targeting polling locations."
The statement appears to be a change in policy from assurances made in February 2026 by Heather Honey, DHS assistant secretary for election integrity, who said, "Any suggestion that ICE is going to be present at polling places is simply disinformation . . . There will be no ICE presence at polling locations."

The city and county of Denver, CO, along with four non-profits, sued DHS challenging their policy of conducting immigration enforcement operations at polling places. The complaint contends that to do so violates 18 U.S.C. § 592, which prohibits "troops or armed men" from being present at election places. The lawsuit is brought under the Administrative Procedure Act, and plaintiffs allege that DHS did not engage in a reasoned decision-making process before implementing this policy.
