Reported: DHS directs privacy-compliance forms to be labeled "drafts" exempt from FOIA disclosure

    Wired reports that the DHS Privacy Office issued a directive requiring all future Privacy Threshold Analyses (PTAs) to be labeled as "draft," "pre-decisional," and "deliberative." PTAs are compliance forms that describe the basic mechanics of new government systems that use or harvest personal data. This designation is to exempt these records from public disclosure under the Freedom of Information Act (FOIA). According to internal communications, the policy change is meant to establish a blanket prohibition on releasing PTAs, which were previously published or released with redactions. DHS has reportedly removed several career CBP privacy and FOIA officials who objected to these orders' legality.
