DHS increases biometric fees for large H-1B and L-1 employers

    CBP issued a final rule, effective September 9, 2026, that would expand the circumstances in which employers must pay the $4,000 H-1B and $4,500 L-1 9-11 Response and Biometric Entry-Exit Fee. Under the rule, businesses with more than 50 employees, at least half of whom are H-1B or L-1 visa holders, will have to pay the fee for all extension of status petitions. Previously, the fee was only paid when employers initially sponsored H-1B and L-1 visas or when a worker changed employers.

    Although the rulemaking was issued by CBP, the 8 CFR section amended is a USCIS rule, and USCIS will collect the fee.
