DHS issues interim final rule allowing USCIS to require mandatory electronic filing

    The Department of Homeland Security (DHS) issued an interim final rule (IFR) amending regulations to allow USCIS to require mandatory electronic filing (e-filing) for any benefit request USCIS has made available for e-filing for at least 180 days. The rule also establishes processes for USCIS to require a benefit request to be e-filed and for a waiver of the e-filing requirement.

    DHS states these changes are being made to implement Executive Order 14247, "Modernizing Payments To and From America's Bank Account." DHS cites a growing trend in e-filing and claims these changes will allow for faster decisions, reduced costs, better risk and fraud data analysis, and more benefits.

    Comments are due October 13, 2026.

    USCIS issued a new Form I-936, entitled "Request for Waiver of E-Filing Requirement." The form requests information from the requestor and information regarding the hardship that complying with the e-filing requirement would cause.

    2026.08.11 USCIS - Form I-936 - Instructions for Request for Waiver of E-Filing Requirement

    USCIS issued new instructions for Form I-936, entitled "Instructions for Request for Waiver of E-Filing Requirement." The new instructions state that one "must clearly demonstrate the undue hardship you would experience by complying with the e-filing requirements." The instructions state that while situations can change, USCIS will take into account prior ability to e-file when deciding to approve a waiver.
