March 14, 2017DHS proposes changes to forms I-864, I-864A, I-864EZ, and I-864W. These forms relate to determinations of whether a sponsor can support a non-citizen visa applicant. Among the changes proposed includes language added to the Form I-864 instructions which indicates "[t]o rely on income for any given year, you must submit an IRS transcript or copy of your Federal individual income tax return for that year." DHS provides the public with 60 days of public comment on the proposed changes. [ID #688]

USCIS has announced that it will discontinue the use of form I-864W, Request for Exemption for Intending Immigrant's Affidavit of Support. Instead, a noncitizen who needs to affirmatively request the exemption from USCIS will be able to request it on their immigration benefit request form by checking the appropriate box.

DHS and USCIS submitted an information collection notice allowing for an additional 30 days for public comments on the notice originally published in the Federal Register on October 26, 2023 regarding revisions to the Affidavit of Support forms, discontinuing the use of form I-864W, Request for Exemption for Intending Immigrant's Affidavit of Support. The October, 2023 notice allowed for a 60-day public comment period, and three comments were received during that time.
