DOS proposes rule ending "B-1 in lieu of H" policy

    DOS issues a notice of proposed rulemaking that would eliminate B-1 visas for certain individuals classifiable as H-1B or H-3 nonimmigrants. Currently, certain persons classifiable as H-1B or H-3 nonimmigrants can instead receive a B-1 visa, referred to as the "B-1 in lieu of H" policy. DOS asserts that the change will provide "greater clarity regarding the Department's policy and interpretation of the law" and better align the issuance of visas with their intended purposes.
