May 6, 2026The Department of Justice (DOJ) announced that it notified the Fairfax County, VA Commonwealth’s Attorney of a federal investigation into that office's “Plea Bargaining, Charging Decisions, and Sentencing Policy.” The policies provide that attorneys “shall consider immigration consequences where possible” and that “prosecutors shall consider . . . the collateral immigration consequences of the specific crime(s) the defendant is charged with[.]” DOJ states that it will investigate whether Fairfax County has discriminated against U.S. citizens “by offering preferential treatment only to illegal alien criminal defendants” in violation of statutory and constitutional law.
