DOJ proposes changes to Form EOIR-26, Notice of Appeal from a Decision of an Immigration Judge

    The Department of Justice (DOJ) provides notice and request for public comments regarding proposed revisions to Form EOIR–26, Notice of Appeal from a Decision of an Immigration Judge. An appeal from an Immigration Judge’s decision is taken by completing Form EOIR–26 and submitting it to the Board of Immigration Appeals (BIA). The form requests information for the Board to process an appeal of an Immigration Judge decision, such as the Respondent's/Applicant's name and alien registration number (A-number), the mailing addresses of the parties and the attorney or representative of record, the basis for the appeal, and proof of service of the notice of appeal.

    DOJ has proposed revisions to this form, including:

    1. formatting and textual revisions to improve organization, clarity, and readability
    2. updated references to online materials, namely to clarify filing instructions for paper and electronic submissions
    3. removed references and collection of information pertaining to the BIA Pro Bono Project, which currently is not an active agency program
    4. added an option to the form for an appellant to specify that he or she is filing an interlocutory appeal from an Immigration Judge decision
    5. added a field to collect the email address for the appellant's attorney or authorized representative.

    DOJ provides 60 days for public comment.

    DOJ published a corrected Federal Register notice, noting that it omitted a change from the proposed revisions to EOIR-26. The correction states that "[c]hanges were made to clarify filing instructions for paper and electronic submissions, including filing fee changes enacted under the One Big Beautiful Bill Act ('OBBBA') (H.R. 1)."
