June 20, 2025The Department of Labor (DOL)’s Wage and Hour Division issued a memo stating that it will suspend enforcement of the Final Rule, “Improving Protections for Workers in Temporary Agricultural Employment in the United States.” The Final Rule, published in April 2024 and effective June 2024, amended regulatory provisions governing the H-2A program. It addressed workers' rights to engage in concerted activity; termination standards and progressive discipline; and wage disclosure and payment obligations. The Rule's implementation had already been paused due to federal injunctions.
The memo states that DOL is “currently evaluating the 2024 Final Rule and considering future regulatory actions.” It directs field staff to discontinue enforcement of the Final Rule; revert to using the H-2A labor-certification process from June 27, 2024, prior to the effective date of the Final Rule; and refer any case-specific questions to the National Office.
