EO 14419: "Ending Birth Tourism"

    President Trump issued Executive Order (EO) 14419, titled "Ending Birth Tourism." The EO provides that it is the policy of the U.S. to promote the integrity of its immigration system, ensure that nonimmigrant visa classifications are used only for their lawful and intended purposes, and prevent the exploitation of those classifications by persons engaging in birth tourism. It defines birth tourism as (a) the entry of any foreign national into the U.S. via a nonimmigrant visa for the purpose of giving birth on American soil and (b) any effort by any foreign national to facilitate the entry of any foreign national into the U.S. via a nonimmigrant visa for the purpose of giving birth on American soil.

    The EO directs the Secretary of State and Secretary of Homeland Security to effectuate the order's policies, including by: preventing the entry of noncitizens entering the U.S. for birth tourism; revoking the visa of any noncitizen who enters the U.S. for birth tourism; removing any noncitizen who engaged in or plans to engage in birth tourism; or taking action against entities, organizations, or individuals facilitating birth tourism.

    2026.08.12 DOS - State Department Establishes Task Force to End Birth Tourism

    The State Department announced that it has established a Birth Tourism Prevention Task Force, which reviews visa holders' activities worldwide to identify birth tourism, revoke the visas of those who engage in or facilitate it, and dismantle "facilitator networks." The Department reported that the Task Force has revoked more than 600 visas, that it generally revokes visas where there are indications of potential ineligibility, and that foreign nationals who willfully misrepresent the purpose of their travel or entry may be permanently ineligible for a visa or admission.
