EOIR issues Policy Memorandum 25-47, specifying agency adjudication priorities

    EOIR has issued Policy Memorandum (PM) 25-47, which aims to clarify EOIR’s case-processing priorities and establish new court-level performance metrics. The updated guidelines purports to "tackle" the immigration case backlog and "restore the integrity of EOIR adjudications for the public that EOIR serves." In doing so, this PM formally supersedes the 2018 memo (on Case Priorities and Immigration Court Performance Measures) and supplements PM 19-13 (Use of Status Dockets) and PM 20-07 (Case Management and Docketing Practices).

    EOIR's priority cases include those subject to completion benchmarks, statutory, regulatory, or federal court-ordered deadlines, or those involving individuals in detainment. Further, this designation will be applied prospectively.

    In addition, EOIR will apply court-based (not individual judge) performance metrics to evaluate whether courts are operating efficiently. EOIR is not reinstating individualized performance measures at this time because, during the first Trump term, such "quotas" were undermined by "partisan and intentional misrepresentation" of the measures. Assistant Chief Immigration Judges will monitor each court’s progress; metrics will help identify courts needing additional resources or management intervention.
