EOIR Director orders more aggressive reporting of ineffective assistance of counsel and attorney misconduct

    The EOIR Director issues a policy memo that directs all EOIR employees to report all suspected violations of the EOIR Rules of Professional Conduct for practitioners (including all judicial findings of ineffective assistance of counsel) to the EOIR disciplinary counsel. The memo requires the report to be made within 60 days of observing or discovering practitioner misconduct. The memo describes "a wide range of conduct" that may provide grounds for discipline, including "contumelious or otherwise obnoxious conduct" and "taking action to cause unnecessary delay." The policy memo applies to both private attorneys and authorized representatives.
