HHS proposes changes to vetting of unaccompanied minors and their potential sponsors

    The Office of Refugee Resettlement (ORR) issued a Notice of Proposed Rulemaking (NPRM) proposing stricter vetting of in-country sponsors for unaccompanied minors in the agency's custody. ORR proposes reinstating a proof of income requirement as part of the sponsor vetting process, limiting the acceptable documents that can be used to prove a sponsor's identity to mostly U.S.-issued forms of ID, and requiring fingerprint-based background checks for all potential sponsors—including parents—and all adult members of a sponsor's household. The NPRM would also authorize ORR to examine unaccompanied minors for "gang-related tattoos and other gang-related markings" when assessing whether a child poses a danger to self or others, and to cover those markings while the child remains in ORR care. Comments are due by August 25, 2026.
