ICE issued Directive 11003.7 to outline requirements for reporting, notification, and review of detainee deaths. The policy supersedes Directive 11003.6. The guidance removes the requirement to report deaths that occur within 30 days of release from ICE custody, meaning that the agency will now only report deaths that occur while an individual is in its custody. The same is true with respect to conducting Detainee Death Reviews by the ICE Office of Professional Responsibility and Mortality Review by ICE Health Service Corps.

The Washington Post reports on the death from hypothermia of a Haitian asylum seeker shortly after her release from ICE custody. Under the June 2026 notification, review, and reporting directive described in this entry, neither this death nor a previous one in 2026 would be subject to notification, OPR/IHSC review, or reporting. The reporting notes that ICE standards contain safe-release requirements.
