The U.S. Department of Justice filed suit against the State of New York to block enforcement of the Local Cops, Local Crimes Act (N.Y. Exec. Law § 170-k), which bans law-enforcement officers from wearing masks and bars New York law- enforcement agencies from entering into or maintaining 287(g) agreements with ICE. The complaint alleges that the law violates the Supremacy Clause and seeks a preliminary injunction against its enforcement. U.S. v. Russo, No. 1:26-cv-01283 (W.D.N.Y.).

2026.07.24 NYS AG Letters on 287(g) Agreements

New York State Attorney General Letitia James and Governor Kathy Hochul sent letters to 12 New York law enforcement agencies that currently have 287(g) agreements with ICE. The letters notify them that the new Local Cops, Local Crimes Act, enacted in May 2026, prohibits local participation in federal immigration enforcement and requires that any existing 287(g) agreements be terminated by August 25, 2026.

2026.08.03 Order on Preliminary Injunction - U.S. v. Russo

A federal judge granted DOJ's request for a preliminary injunction preventing enforcement of a provision banning law enforcement officers from wearing masks. The order denied enjoining enforcement of a ban on 287(g) agreements between New York law enforcement and ICE. U.S. v. Russo, 1:26-cv-01360 (N.D.N.Y.) (venue transferred from W.D.N.Y.).

2026.08.25 Complaint - Bourgault v. Hochul

A group of 16 New York county sheriffs filed suit challenging state laws that prohibit local law-enforcement agencies from cooperating with federal immigration authorities, including through 287(g) agreements and contracts to house immigration detainees. The sheriffs argue that the laws are preempted by federal immigration law and violate the U.S. Constitution and New York law by interfering with their authority as independently elected officials. They seek to block the laws' enforcement and preserve their ability to cooperate with federal immigration authorities. Bourgault v. Hochul, Case No. 1:26-cv-01637 (N.D.N.Y.).

2026.08.27 Complaint - New York v. Bourgault

The Governor of New York and the New York Attorney General filed suit in state court against the Rensselaer County Sheriff's Office, alleging it has not complied with a new state statute requiring local law enforcement to end 287(g) agreements. The complaint alleges that since 2010 the Sheriff's Office has maintained a memorandum of agreement that is now unlawful under the Local Cops, Local Crimes Act (N.Y. Exec. Law § 170-k(7)(a)).
