July 18, 2025The National Law Review reports the Department of Homeland Security (DHS) is issuing Notices to Appear to H-1B visa holders who are within the 60-day grace period after the end of their employment, during which 8 CFR 214.1(l)(2) provides that they are not considered to have failed to maintain their status. However, the regulation provides that "DHS may eliminate or shorten this 60-day period as a matter of discretion." The report indicates that "USCIS may be exercising discretion to eliminate the 60-day grace period in some cases . . . [T]here have not been prior widespread changes to the duration of the grace period" since the publication of the regulation in 2016.
