May 29, 2026The Office of Management and Budget (OMB) issued a Notice of Proposed Rulemaking (NPRM) relating to the Guidance for Federal Financial Assistance. The revisions will impact government-wide policies and requirements related to the management of federal financial assistance, including grants and cooperative agreements. The NPRM proposes many changes, including two that directly implicate immigration.
First, the proposal would require all recipients and subrecipients of federal financial assistance to participate in DHS's E-verify program to confirm the immigration status of employees and contractors hired in or performing work in the United States under a federal award. This would extend an existing mandate that has applied to federal contractors to now cover federal grant recipients. Existing DHS exceptions and limitations would remain intact, and the requirement would not apply to activities unrelated to the federal award.
Second, the proposal revises the merit-review process for discretionary award applications to add a pre-issuance review requirement, under which agencies must perform pre-issuance review to ensure that federal award proposals selected for funding are "consistent with applicable law, Federal agency priorities, and the national interest." Notably, awards may not be used to fund or facilitate "[i]llegal immigration" or "[a]ny other initiatives that compromise public safety or promote anti-American values." The pre-issuance review must be conducted by one or more senior appointees or their designee.
Comments on the proposed rule are accepted until July 13, 2026.
