June 9, 2025According to a complaint in O. v. Helland, ICE issued email guidance to all ERO personnel regarding detainees in the Alternatives to Detention (ATD) program (see p.26 of Complaint). This program allows the government to monitor individuals living outside of detention as they complete their immigration proceedings.
The guidance provides that post-order noncitizens in the program, currently assigned to virtual check-ins, will be moved to in-person check-ins. It directs staff to equip noncitizens with GPS ankle monitors "whenever possible and increase reporting requirements," and prohibits the release of noncitizens on Order of Release on Recognizance or an Order of Supervision without technology. It states that all pregnant individuals should be placed on wrist-worn technology.
The complaint alleges that the policy is contrary to the INA, governing regulations, and decades of ICE policies requiring an individualized assessment to determine appropriate conditions of release. It states that the number of individuals wearing GPS ankle monitors has nearly tripled since the email, even as the total number of ATD participants has remained stable. Plaintiffs allege that the rule violates the Administrative Procedure Act and Due Process Clause and seek declaratory and injunctive relief. O. v. Helland, No. 1:26-cv-02279 (D.D.C.).

2025.07.24 Washington Post - CE moves to shackle some 180,000 immigrants with GPS ankle monitors
The Washington Post explains that ankle monitors are used on only 13% of ATD participants, while the majority of participants are subject to less intrusive monitoring methods, such as being required to complete virtual check-ins. Immigration attorneys have expressed concerns with the expanded use of ankle monitors, which are physically cumbersome and socially stigmatizing.
