May 30, 2026USCIS archived a page on its website titled "Options for Nonimmigrant Workers Following Termination of Employment." Among other things, the website contained guidance that searching and interviewing for a job were permissible activities while in B-1 or B-2 status. Based upon this guidance, laid-off H-1B holders have historically changed status to B-2 in order to search for employment and then changed status back to H-1B upon finding new employment. Practitioners report an increasing number of Requests for Evidence, Notices of Intent to Deny, and denials since early 2026 for these change-of-status applications.
