August 21, 2026USCIS posted a series of alerts on its Asylum website describing policy changes regarding affirmative asylum interviews.
- All applicants for asylum must now submit evidence 14 calendar days before the applicant's scheduled interview and evidence submitted within the 14-day period before the applicant's interview may not be included in the asylum application or it may lead to the interview being rescheduled. Rescheduling may affect eligibility for an Employment Authorization Document (EAD).
- Asylum interviews and biometric services interviews will be rescheduled only in "exceptional circumstances." Failure to appear for the asylum interview or submit a request to reschedule before the interview date or within 10 calendar days after the missed interview may lead to dismissal of the asylum application or referral to removal proceedings. Similarly, failure to request rescheduling of the biometrics appointment within 10 calendar days of the missed appointment--and failure to simultaneously submit evidence of exceptional circumstances--may result in dismissal of the application or referral.
Parolees who fail to appear at an asylum interview or biometric services appointment may have their parole terminated and may be referred to removal proceedings.

The Asylumist explains that changing the evidence submission deadline from 7 days prior to an interview to 14 days prior will pose significant challenges to applicants and their attorneys. Similarly, the new "exceptional circumstances" requirement for rescheduling requests may be difficult to meet for various reasons.
