A federal judge ordered his release after finding he was likely detained in violation of the First Amendment. The administration continues to seek his deportation, citing a decades-old Israeli military conviction that Sarsour says was extracted through a coerced confession obtained under torture. Sarsour described harsh detention conditions, including inadequate medical care, poor food, and restrictions on religious practice.
His lengthy detention followed the BIA's April 9, 2026 decision in Matter of M-K-, which held that the Secretary of State's "facially valid" foreign-policy determinations supporting removability under INA section 212(a)(3)(C) are not reviewable by immigration judges.
