DOS proposes rule to tighten regulations for J-1 visa programs

    The Department of State proposed a new rule that tightens regulations for J-1 visas, a temporary visa category for foreign nationals in educational and cultural exchange programs.

    The proposed rule provides an additional basis for which a sponsor must terminate an exchange visitor’s participation, namely when the exchange visitor falsifies or fails to provide a full and truthful response, information, or documents as part of their application or during the ongoing exchange program. It also expands circumstances where the DOS may terminate the exchange visitor program participation, such as when the participant's visa is revoked or if the participant falsifies information in their application. The rule also establishes a new procedure for participants to challenge the DOS’s termination decision, and sets stricter deadlines for submitting program extensions and reinstatement requests through the government’s online tracking system (SEVIS).
