Trump DOJ negotiates settlement requiring developer to earmark funds for immigration enforcement

    A settlement agreement resolving separate lawsuits filed by the State of Texas and the Consumer Financial Protection Bureau (CFPB) against Texas-based developer Colony Ridge, Inc. requires the developer to earmark $20 million for law enforcement in its subdivisions, including setting aside money for immigration enforcement. Further, the settlement requires potential purchasers to present a Texas ID, driver's license, or a passport or visa. The complaints by Texas and the United States accused Colony Ridge of targeting Hispanic and foreign-born home buyers with little to no credit with predatory lending and foreclosure practices.     District Judge Alfred Bennet dismissed the case with prejudice following a Stipulation of Dismissal filed by the parties. However, the court also noted several concerns that it had with the settlement agreement. It states that the agreement “bears little relationship to the claims asserted in the Complaint,” noting that terms on law enforcement funding “do not remedy the misconduct alleged," and that the agreement “risks exacerbating harm to the very consumers the Complaint purported to protect” by increasing surveillance.     The Consumer Financial Protection Bureau (CFPB) filed a complaint against Texas-based developer Colony Ridge, alleging that the developer engaged in "discriminatory targeting of Hispanic consumers with predatory financing and other unlawful conduct" in violation of the Equal Credit Opportunity Act, the Fair Housing Act, the Consumer Financial Protection Act, and the Interstate Land Sales Full Disclosure Act. The complaint requests injunctive relief ordering Colony Ridge to cease discriminating on the basis of race or national origin, take affirmative steps to restore the victims and prevent future discriminatory conduct, and provide restitution to victims, among other relief.

    The State of Texas filed a complaint against housing developer Colony Ridge, Inc., alleging that the developer's business model "targets foreign born and Hispanic consumers with limited or no access to credit with promises of cheap, ready to build land," fails to disclose fatal flaws with the land, and then forecloses on the rapidly-defaulted consumers. The State alleges that this practice violates the Deceptive Trade Practices—Consumer Protection Act (DTPA) and the Consumer Financial Protection Act (CFPA).
