USCIS revises age calculation under the Child Status Protection Act for adjustment of status applications

    USCIS issued policy guidance reversing a Biden administration policy regarding the Child Status Protection Act (CSPA). The revised guidance requires applicants to use the "Final Action Dates" chart in the DOS Visa Bulletin to calculate a beneficiary's age under CSPA for the purposes of adjustment of status applications, rather than the "Dates for Filing" chart. USCIS states that the policy “establishes parity for CSPA age calculation” for noncitizens who apply for adjustment of status and immigrant visas while abroad, as age calculation for the latter is governed by the "Final Action Dates" chart.

    The update, contained in Chapter 7 of the USCIS Policy Manual, is effective August 15, 2025, and applies to requests filed on or after the effective date. USCIS will continue to apply the prior policy to noncitizens whose adjustment of status applications were pending before August 15 or who demonstrate extraordinary circumstances for not applying for adjustment of status before August 15.
