USCIS proposes to collect social media identifiers on certain forms to enhance screening and vetting of applicants

    USCIS issued a 60-day notice and request for comments on a proposed new information collection, "Generic Clearance for the Collection of Social Media Identifier(s) on Immigrant Forms," pursuant to section 2 of the EO “Protecting the United States from Foreign Terrorists and Other National Security and Public Safety Threats.” USCIS seeks to collect the social media identifiers and associated social media platform names from applicants. This information will be collected on 9 current USCIS applications and petitions, including naturalization, asylum, registration for permanent residence and adjustment of status, travel documents, and refugee/asylee relative petitions. USCIS alleges this data collection is necessary "for the enhanced identity verification, vetting and national security screening and, inspection conducted by USCIS and required under the E.O."

    Comments are due on May 5, 2025.

    AP News reports that Rachel Levinson-Waldman, managing director of the Brennan Center's Liberty and National Security Program, said of the proposed rule that "[t]he basic requirements that are in place right now is that people who are applying for immigrant and non-immigrant visas have to provide their social media handles . . . This fairly widely expanded policy to collect them for everyone applying for any kind of immigration benefit, including people who have already been vetted quite extensively."
