USCIS published new Form I-9 guidance in Section 6.9, Other Temporary Workers, of the M-274, Handbook for Employers. The guidance indicates that employees whose E and L nonimmigrant status derives from being the spouse of an E or L nonimmigrant can show Form I-94 as proof of employment authorization. A separate employment authorization document (EAD) is no longer required.
