USDA imposes immigration-enforcement conditions on grants and agreements

    According to a lawsuit filed by twenty states and the District of Columbia, the U.S. Department of Agriculture (USDA) published new conditions on December 31, 2025, for all recipients and subrecipients of USDA grants, cooperative agreements, and mutual interest agreements. Among other things, the conditions require funding recipients to certify compliance with certain executive orders, including EO 14218, and prohibit directing funding toward programs that "allow illegal aliens to obtain taxpayer-funded benefits, provide public resources to meet the needs of illegal aliens, or provide incentives for illegal immigration by demonstrating the availability of public benefits." Plaintiffs allege that the conditions violate the Constitution and the Administrative Procedure Act, and seek declaratory and injunctive relief. Commonwealth of Massachusetts v.
