DOL rescinds regulations requiring agencies to coordinate protections for migrant and seasonal workers

    The Department of Labor (DOL) rescinded longstanding regulations designed to "improve coordination among its component agencies in enforcing protections for migrant farmworkers." Codified at 29 CFR part 42 in 1980, the regulations required several federal agencies--including OSHA, National Farm Labor Coordinated Enforcement Committee, and the now-defunct Employment Standards Administration--to coordinate their activities. A 2024 lawsuit against DOL alleging that it had long failed to comply with this regulations resulted in a settlement under which DOL agreed to resume certain coordination activities as long as required under the regulations. On July 1, 2025, DOL published a Notice of Proposed Rulemaking to rescind the regulations. The rescission rule goes into effect September 30, 2026.
