ORR proposes new instruments for information collections relating to the care of unaccompanied children

    ORR has proposed the addition of new instruments to its existing information collection activities and will accept public comment for 60 days. Ten proposed new instruments are to be added to the Services Provided to Unaccompanied Alien Children into ORR Care Provider Facilities information collection (OMB #0970-0553), three are to be added to the Placement and Transfer of Unaccompanied Alien Children into ORR Care Provider Facilities (OMB #0970-0554), and one is to be added to the Administration and Oversight of the Unaccompanied Alien Children Program (OMB #0970-0547).

    Specifically, the ten instruments added to OMB #0970-0553 address the following: 1) admission; 2) home study/post-release services primary provider entity 3) home study/post-release services subcontractor entity; 4) home study/post-release services primary provider profile; 5) home study/post-release services subcontractor profile; 6) home study/post-release services referral; 7) post-release services event; 8) UAC authorized/restricted call list and log; 9) case manager call log; and 10) Ohio youth assessment system reentry tool.

    The three instruments added to OMB #0970-0554 address the following: 1) family group entity; 2) influx transfer manifest and 3) influx transfer manual and prescreen criteria review.

    The one instrument added to OMB #0970-0547 addresses notification of concern, specifically relating to notifying ORR of certain concerns that arise after a UAC is released from ORR custody.

    On October 4, 2023, the Department of Health and Human Services through the Administration for Children and Families’ (ACF) Office of Refugee Resettlement (ORR) issued a Notice of Proposed Rulemaking (NPRM) on the "Unaccompanied Children Program Foundational Rule."

    This proposed rule would codify a framework for the care and custody of unaccompanied children consistent with ORR’s statutory authorities and responsibilities, as well as with requirements established in the 1997 Flores Settlement Agreement (FSA). It would set comprehensive standards for the care and treatment of unaccompanied children in ORR’s custody, and update collection of information requirements established during the Trump administration and outlined in this original policy entry.
